The regulations of the provision of services for patients of NZOZ Biomol-Med 

1. General provisions.

1.1. In accordance with the requirements of article 8 of the act from the18th of July 2002 on the provision of services via electronic means (Journal of Laws from 2002, no. 144, pos. 1204 with amendments) the Regulations determine the types and conditions for the provision of services via:

  • Online shop, separate part of the internet service available under the address of  sklep.biomol.pl (further referred to as the Service),
  • Infoline +48 042 630-49-11  (further referred to as the Infoline), 

through Biomol-Med Sp. z o.o. located in Łódź (further referred to as the Company). 

1.2. The service user, further referred to as the User is an adult person with full capacity to exercise legal rights.

2. Registration in the system

2.1  Registration and using the Service is free of charge.

2.2  In order to register, the User is required to provide the personal details required by the Service Owner. 

2.3  The User registration in the Service is divided into three parts:

  • Creating an account;
  • Adding selected service to the basket;
  • Order payment ;
  • Following a correct payment verification, a link to an e-questionnaire is sent to the e-mail address provided along with the test number and the User’s declaration;
  • The Service User is obliged to fill out the questionnaire and send a hair sample along with the declaration to the following address: NZOZ Biomol-Med Sp. z o.o., 94-412 Łódź, ul. Huta Jagodnica 41;
  • NZOZ Biomol-Med informs the User about the sample received and estimated date of implementation via e-mail.  

 

3. Implementation of services.

3.1  NZOZ Biomol-Med carries out the testing of samples received from the Patient.

3.2  NZOZ Biomol-Med provides the instructions regarding the correct sample taking for testing. Detailed description: http://biomol.pl/uslugi/

3.3  Full information about the services is provided on the website of NZOZ Biomol-Med www.biomol.pl.

3.4  The staff may provide such information on the phone upon the Client’s request.

3.5  The test results are produced within the deadline counted from the date of receipt of the filled out questionnaire, hair sample and photocopy of the payment confirmation by: NZOZ Biomol-Med:

  • 15 working days (Hair Elements Analysis – Health Programme, Analysis of 12 elements – Prophylactic Programme, Nutritional Condition Diagnostics, Nutritional Condition Diagnostics Programme);
  • 10 working days (other tests).

3.6  NZOZ Biomol-Med informs the patients about the sample received and estimated date of implementation via e-mail providing the patients has:

  • filled out the questionnaire (full name, age, weight, height, delivery or/and e-mail address);
  • attached payment confirmation and made payment in accordance with the current price list http://biomol.pl/cennik/;
  • sent a sample which meets the requirements http://biomol.pl/uslugi/.

3.7  In case it is not possible to carry out the tests ordered due to overworking, temporary inability or lack of technical possibilities, the Client is informed about the potential date by which their order shall be implemented.

3.8  Any discrepancies between the requirements specified in the agreement or in the order are clarified before the works start.

3.9  Test subcontracting is not the practice of the Non-Public Health Centre Biomol-Med Sp. z o.o.

3.10  Any tests ordered by the Client are accepted by the Laboratory Manager, the tests are carried out by the laboratory personnel using the equipment owned by NZOZ Biomol-Med.

3.11  Before accepting the order, the Management of NZOZ Biomol-Med always checks whether there are sufficient material and staff resources to implement the given orders.

3.12  Entries from the review of requirements regarding the product are included in the test history on the Intranet. The proof of carrying out the review of requirements regarding the product is registering the test on the Intranet.

3.13  NZOZ Biomol-Med keeps the documentation regarding the determination of individual characteristics of the research methods used.

ADDITIONAL SERVICES

DESCRIPTION for the HAIR ELEMENTS ANALYSIS – Analytical Programme (from the age of 3)

  - description of metabolic type and health tendencies;
  - 2 supplementing programmes: compensatory for 1-3 months and prophylactic for 6 months;
  - diet for 7 days with recipes and physical activity recommendations;
  - sending the electronic version of the test result to the e-mail address.

NUTRITIONAL CONDITION DIAGNOSTICS (over 18).

It is a test which can be ordered after carrying out the Hair Elements Analysis – Health Programme. It should be carried out between 6 months and 2 years from receiving the Hair Elements Analysis – Health Programme, having followed the supplementary and dietary recommendations.
The test is for adults (over 18).

  - marking 29 elements in hair;
  - comparison with the previously tested Hair Elements Analysis – Health Programme;
  - description of the metabolic type;
  - 12-month prophylactic supplementary programme;
  - diet for 14 days with recipes and physical activity recommendations;
  - paper version of the test results sent via post and the electronic version sent to the e-mail address.

NUTRITIONAL CONDITION DIAGNOSTICS PROGRAMME (over 18)

It comprises of firstly carrying out the Hair Elements Analysis – Health Programme and then carrying out the Nutritional Condition Diagnostics between 6 months and 2 years after that. These tests are bought together and are payable in advance. They are for one person and called the Nutritional Condition Diagnostics Programme. In order to carry out the test, please make the payment and get in touch with us in order to receive the relevant test questionnaires. The test is for adults (over 18).

ADDITIONAL DESCRIPTION IN A DIFFERENT LANGUAGE with the delivery of the paper version via post (from the age of 3)

Applies to:

  - Hair Elements Analysis – Health Programme – available in the following languages: English, German, Czech, Russian, Ukrainian;
  - Hair Elements Analysis – Health Programme (without the diet) - available in the following languages: Slovak, French, Italian, Romanian, Hungarian;
  - The 12 Elements Analysis – Prophylactic Programme - available in the following languages: English, German, Czech, Russian, Ukrainian, Slovak, French, Italian, Romanian, Hungarian.

RESENDING THE TEST RESULTS in the paper version via post

Applies to:

  - Hair Elements Analysis – Health Programme;
  - Nutritional Condition Diagnostics;
  - The 12 Elements Analysis – Prophylactic Programme;
  - Sending the description of the Hair Elements Analysis – Analytical Programme.

 

5.  Provision of services

5.1  NZOZ Biomol-Med has the complete administrative and diagnostics-research equipment necessary for the correct implementation of the processes within the range of its activity. 

5.2  The equipment and software used at NZOZ Biomol-Med, used for the implementation of the processes ensure the required precision and meets the requirements included in the specifications regarding the processes.

5.3  The description of the test is the know-how of NZOZ Biomol-Med, and its individual elements are described in point 4 of these Regulations and biomol.pl/usługi/  

5.4  The diet supplements recommended in the results are quoted in systematic names. They are widely available and can be easily obtained from pharmacies, herbal shops or on the Internet. NZOZ Biomol-Med does not provide trade names of the indicated preparations, not promoting any company distributing diet supplements. However, obtaining preparations of natural origin is recommended. The Patient purchases the preparations at their own responsibility, verifying their contents with a physician or a pharmacist.

5.5  The diet recommended in the results is an optimal diet for the patient’s metabolic type and their body’s needs. The function of this diet is indicating the nutritional targets which should be set in order to achieve the best results and support the supplementary programme. The recommended metabolic diet does not take into consideration the tested person’s previous nutritional preferences.

5.6  Consulting the test results is free of charge and carried out in the form of courtesy phone conversation with the Service User, not included in the cost of the test.

5.7  The Service Owner informs the Users about the opportunity to have a conversation and sets a date (one day a week within the times indicated), informing in advance that the conversation:

  • is a one-off;
  • takes place once the User quotes the test number;
  • may only relate to the supplementation and the diet indicated in the results (analytical tests are not subject to consultation);
  • is noted down in the test history;
  • it is not possible to make a complaint against the consultation;
  • is not a form of treatment. 

6. Responsibility and reservations

6.1  NZOZ Biomol-Med administers the Service.

6.2  The Service Owner makes all the effort to ensure that all the available functionalities of the Service work continuously and without interruptions.

6.3  The Service Owner reserves the right to shut down the Service’s availability periodically in order to develop and update it.

6.4  The Service Owner takes no responsibility for:

  • the consequences of sharing the Login or Password, regardless of the fact whether the third party gained access to this information with or without the User’s consent;
  • the damages resulting from using the Service by the User in an incorrect way, failing to abide by these Regulations;
  • the problems with the Service’s functioning, providing they occurred as a result of events, which, whilst exercising due diligence, could not have been foreseen or stopped by the Service Owner, especially in the case of problems with the Service’s functioning related to the quality of service provided by the telecommunication providers;
  • the sudden cuts in functioning of the Service due to the malfunction of the equipment or the IT systems or other circumstances which are beyond the Owner’s control.

7.  Privacy Policy / Security Policy

  1. The Service Owner shall make all the effort to protect the Users’ data with the use of the latest technology, in accordance with the security requirements and confidentiality rules in place.
  2. The Service Owner agrees to store and share the information provided by the User in accordance with the current legal norms.
  3. It is forbidden to copy / use the information available in the sklep.biomol.pl www.biomol.pl Service without the Owner’s consent.

8.  The Service Administrator  

8.1  The protection of the Users’ personal data is ensured by the Service Owner.

8.2  The protection of the Users’ personal data is ensured through:

  • Data transmission encoding system ;
  • Login – User’s e-mail address;
  • Password – provided by the User when logging into the Service;

8.3  The Service Owner implements the privacy policy and the policy of data security in the Service using:

  • system logs containing information about dates and times;
  • secure data transmission using the HTTPS protocol;
  • data encoding using the SSL protocol;
  • secure access to User’s personal data through Password;
  • technical and organizational measures relevant to the risks and categories of data shared in the Service.

9. The User

9.1  The User has the right to access their data in the Service and amend them through the administrator.

9.2  The User cannot include in the Service the content not related to the aims of the Service, especially the content which is against the law, the principles of morality and the norms of social coexistence as well as the content which concerns advertising.

9.3  Due to the security of the User’s personal data, the Password selected by the User should not be the same as the password used in the User’s e-mail account or other services, which require a password (e.g. internet forum, blog etc.).

9.4  Should the User suspect that an unauthorized person has access to their account, they shall inform the Service Owner about the problem by sending an e-mail to the following address: biuro@biomol.pl

9.5  The User may demand the personal data, which concern them to be supplemented, updated or amended.

10. Complaints

10.1 Complaints regarding the incorrect functioning of the Service, may be notified by the User:

  • in person at NZOZ Biomol-Med.;
  • by sending a complaint via post to the following address: NZOZ Biomol-Med., 94-412 Łódź, Huta Jagodnica 41;
  • by sending a complaint electronically to the following address: biuro@biomol.pl

10.2 The Service Owner is obliged to reply to a complaint within 14 days from the date of receipt, indicating whether they accept the complaint and the way they intend to consider it or informing about the insufficient basis to consider it and providing justification for the refusal. The reply to the complaint is sent by the Service Owner to the User electronically to the e-mail address provided in the Declaration.

10.3 The Service Owner takes no responsibility for the problems with / technical limitations of the computer equipment used by the User, which make them unable to use the Service. In order to use the Service, the User must have computer equipment with access to the Internet and a web browser.

11. Changes to the Regulations

11.1 The Service Owner reserves the right to change these Regulations at any time. The current version of the Regulations is available on: sklep.biomol.pl/regulamin.

11.2 The information regarding the changed Regulations will be forwarded to the User through a message in the Service. The information about the awaiting message shall be sent to the User’s e-mail address indicated in the Declaration. 

11.3 The updated version of the Regulations is in place from the time it is published in the Service.
